1. Who you are contracting with

BetterThanYou.lol is a brand of IURELY SRL, a company incorporated in Italy. Your contract is with that company.

In these terms, “we”, “us” and “the platform” mean IURELY SRL. “You” means the person using the service.

2. What the service is

betterthanyou.lol is a public leaderboard on which the only factor determining position is the amount of money paid for that position. There is no algorithm, no quality assessment, no editorial selection, no voting and no popularity measure. The name is a joke about that fact; the mechanic is not a joke.

A position on this board is not an endorsement, and it is not a claim that anybody is actually better than anybody else. It says nothing about the merit, quality, reputation, legality or trustworthiness of the person listed. It records only that somebody paid. We make no representation whatsoever about anybody listed.

3. Accounts

• You must be at least 18 years old and legally able to enter into a contract.
• You are responsible for everything done through your account, and for keeping your credentials secure.
• You must give accurate information and keep it up to date.
• One person, one account. Accounts created to evade a suspension will be closed.

4. How bidding works

The mechanic is fixed and applies identically to everyone:

• Position is ordered by the amount of the standing bid, highest first.
• Where two bids are equal, the bid placed earlier ranks higher.
• Bids are in whole US dollars, in steps of $1, and never exceed $999,999.
• The minimum bid rises as the board fills. It is $5 at the time of writing, and the current figure is always displayed before you pay. The amount that applies to you is the one shown at the moment you confirm.
• There is a cap on how far above the current leader you may bid. You cannot bid more than $100 above the standing bid of the current #1. This exists so that a single large bid cannot make the top position unreachable and bring the board to a halt. You may take the top position and then raise again from there. We may adjust this cap, and the minimum, as the board grows; changes never apply retroactively to bids already paid.
• To take a position you must pay strictly more than whoever currently holds it — at least $1 more.
• If you already hold a seat, raising it costs only the difference between your new and previous bid.
• Bidding less than the leader does not fail: you are placed at the highest position your amount buys at that moment.

5. What you are buying, and what you are not

You are buying a position in an ordering, for as long as nobody outbids you. You are not buying:

• a guaranteed position, for any period of time;
• a guaranteed number of visitors, clicks, impressions or any commercial outcome;
• advertising space, a backlink of any particular value, or any SEO benefit;
• exclusivity of any kind.

You can be overtaken at any moment, by anyone, for one dollar more. That is the entire point of the product and is not a defect. Being outbid does not entitle you to a refund, a credit or compensation.

6. Payment

• Prices are in US dollars (USD) and are shown before you confirm.
• Payments are processed by Stripe. We never receive or store your full card details.
• The platform retains the full amount bid. There is no revenue share, no payout and no subscription.
• Where VAT or other taxes are due, they are handled in accordance with applicable law and shown at checkout.
• Your bid takes effect only once payment has actually settled.

7. Right of withdrawal, and why it ends immediately

If you are a consumer resident in the European Union, you normally have 14 days to withdraw from a distance contract, under Articles 9 and following of Directive 2011/83/EU (in Italy, Articles 52 ff. of the Consumer Code, Legislative Decree 206/2005).

Because a bid takes effect on the public board immediately, we ask you, before each payment, to:

• expressly request that we begin performance straight away; and
• acknowledge that once the position has been assigned, the service is fully performed and you therefore lose your right of withdrawal (Art. 16(a) of the Directive; Art. 59(1)(a) of the Italian Consumer Code).

You confirm this with a tick box at the moment of bidding, and we record it against that specific bid. If you do not give that confirmation, we cannot seat the bid. If we fail to obtain it, your 14-day right stands and you may withdraw by writing to info@betterthanyou.lol.

Nothing here removes your statutory rights where a service was not delivered as described, or was charged in error.

8. Refunds

• No refunds for being outbid, or for losing position. That is the product working as described.
• We will refund a payment that was charged in error, taken twice, or never resulted in the position being assigned.
• If we remove your seat for breaking these terms, the amount paid is not refunded.
• If we permanently discontinue the service, we do not owe a refund of positions already held and displayed, since the service will have been performed.
• Where we do refund a bid, the position reverts to its previous amount, unless it has since been raised again with a separate payment.

9. What you may not list

You may not use the platform to publish, link to or promote:

• sexual or pornographic content of any kind;
• group-chat invitations (Telegram, WhatsApp, Discord invites, Signal groups and similar);
• an identity that is not yours and that you are not authorised to represent. Paying does not buy the right to impersonate somebody;
• content that is unlawful, defamatory, harassing, hateful, or that targets a private individual;
• malware, phishing, scams, or misleading commercial claims;
• content infringing anyone's intellectual property or privacy;
• anything concerning a person under 18.

You confirm that you hold all rights necessary for what you submit, and you grant us a non-exclusive, worldwide, royalty-free licence to display it on the platform for as long as it is listed.

9-bis. Verification of identity

Some seats carry a verified mark. That mark means only that we have checked, to our reasonable satisfaction, that the seat is held by the person or representative it names. It is not an endorsement, it says nothing about the merit of that person, and its absence does not imply that a seat is illegitimate. We may add or withdraw the mark at any time, and we do not charge for it.

10. Links, tracking parameters and clicks

• Tracking and affiliate parameters are stripped from your link automatically.
• Shortened links are resolved to their final destination; if we cannot resolve one, we do not publish it.
• Clicks are counted and displayed publicly. One visitor is counted once per seat per hour. Click counts, cost-per-click figures, and the visitor numbers shown on the board are provided in good faith as an indication, not as audited metrics. They describe the past and are not a forecast or a guarantee of any future traffic.
• We also publish how long each seat has held the top position. That record remains visible after the seat has been overtaken.
• Attempting to inflate your own click count is a breach of these terms.

11. Publicity and permanence

A paid seat is public. Its name, handle, description, link, standing bid, full bid history and click count are visible to anyone, and may be indexed by search engines, cached, screenshotted or shared by third parties beyond our control.

You can raise your bid at any time. You cannot hide your seat, and you cannot make the fact that you paid non-public. Consider this carefully before bidding.

This does not override your data protection rights: you may always ask us to erase your personal data, and how we handle that — including anonymising a seat while keeping the accounting record required by tax law — is set out in our Privacy Policy.

12. Moderation

Paying does not place you above the rules. We may hide or remove a seat, and suspend or close an account, where these terms are broken or where we are legally required to. We aim to act proportionately and to give a reason. Every moderation action is logged internally.

If you believe a seat breaches these terms — including because it impersonates you — write to info@betterthanyou.lol with the details and we will review it.

13. Availability

The service is provided “as is”. We do not promise uninterrupted availability, and we may suspend, change or discontinue any part of it. We may pause bidding at any time; positions already paid for remain displayed while the service runs.

14. Liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or in connection with the service is limited to the total amount you paid us in the twelve months preceding the event giving rise to the claim.

We are not liable for indirect or consequential loss, lost profit, lost opportunity, loss of reputation, or for the conduct or content of other users or of any site you reach by clicking a seat.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded — including liability for death or personal injury caused by negligence, for fraud, for wilful misconduct or gross negligence, or any mandatory consumer rights you have under Italian or EU law.

15. Changes to these terms

We may update these terms. The version in force is identified by the date at the top of this page. Material changes will be announced on the platform. Bids already placed remain governed by the version accepted at the time, which we store with the bid.

16. Law and jurisdiction

These terms are governed by Italian law. Disputes fall to the courts of Rome, Italy.

If you are a consumer, you may instead bring proceedings in the courts of your place of residence, and you keep the benefit of any mandatory protections of your country of residence. Consumers may also use the European Commission's online dispute resolution platform.
